Objetivamos elaborar um balanço sobre lógica das perguntas científicas na produção do conhecimento stricto sensu. Tomamos como fontes 100 dissertações e 32 teses escritas por docentes que trabalham em cursos de Educação Física no Estado da Bahia – 1982 a 2018, abordando enquanto objeto a lógica instituída pelas perguntas científicas na referida produção. Trata-se de uma pesquisa documental, tendo como método o materialismo histórico e dialético. Os resultados apontam que 48% das produções têm suas perguntas de investigação construída a partir (...) da lógica formal; 28% apresenta uma lógica dialética na elaboração das perguntas científicas; e 24% não apresentam problema de investigação. Este artigo propõe uma discussão sobre jornalismo e subjetividade a partir de uma argumentação que considera que, embora o discurso hegemônico sobre a instituição se construa a partir do ideal da objetividade, de um texto constituído apenas pelos fatos e cujo autor deixa de ser sujeito para assumir a identidade de jornalista, a subjetividade foi sempre constituidora do texto jornalístico. Assim, pensando a partir dos estudos culturais o jornalismo como uma instituição social com formas, valores e funções conformados historicamente, e (...) os sujeitos como indivíduos que se reconhecem a partir de uma ampla rede de relações de poder, de tradições culturais, de representações de identidades, argumentamos que, em um contexto cada vez maior de centralidade dos sujeitos na cultura contemporânea, os discursos sobre si tem sido uma forte tendência também no jornalismo. Esse trabalho sistematiza a experiência de um estudo de caso realizado por um coletivo de pesquisadores em formação no grupo de LEPEL/FACED/UFBA. Têm em consideração, condições objetivas concretas de uma pesquisa em rede, promovida a partir de um trabalho voltado para elevar o pensamento teórico-metodológico de pesquisadores. Os resultados apontam que uma consiste formação de pesquisadores em rede, visando elevar o pensamento teórico-metodológico, requer estudos em uma rigorosa matriz categorial de referência marxista, cuja concepção histórica se pauta em conceber de (...) forma crítica o intercâmbio do modo de produção econômico capitalista, que engendra a produção do conhecimento científico. Adotando como referencial teórico a obra de Jürgen Habermas, bem como as bases para o seu pensamento na Escola de Frankfurt, o presente artigo busca analisar em que medida o horizonte que se vislumbra diante da crise sanitária pode ser tomado em perspectiva para se pensar a questão do direito ao meio ambiente sustentável. Para tanto, realizou-se uma pesquisa qualitativa, sob o método hipotético-dedutivo, em uma abordagem exploratória e adotando a técnica de pesquisa bibliográfica. Ao final, conclui-se que a racionalidade (...) moderna necessita de novos paradigmas na relação homem-natureza, a qual não se pode ser mediada pela razão instrumental hegemônica. (shrink)

O artigo é um estudo de caso à luz da filosofia jurídica de Dworkin. Tratou-se de recursos especial repetitivo do Superior Tribunal de Justiça, que inviabilizou a utilização da indenização punitiva, espécie de responsabilidade civil derivada da common law. A pesquisa busca analisar o voto vencedor, propondo argumentos com uso da tese do ativismo judicial sobre a possibilidade de utilização da punitive damage em matéria ambiental. O presente trabalho foi desenvolvido sob a metodologia jurídico-teórica e raciocínio dedutivo, com pesquisa bibliográfica (...) e jurisprudencial. Conclui-se que por meio do ativismo judicial há possibilidade de aplicação da indenização punitiva em matéria ambiental. (shrink)

Este artigo objetiva apresentar os resultados de uma investigação sobre a influência do contexto histórico-literário do niilismo russo — com destaque para o papel desempenhado pelo romance Pais e Filhos — no desenvolvimento das primeiras reflexões de Nietzsche sobre o niilismo, as quais foram registradas em dois textos póstumos de 1880. Principiando com um esclarecimento sobre a origem da palavra niilismo, o texto prossegue com uma caracterização do contexto social, político e cultural do Império Russo na segunda metade do século (...) XIX. Na sequência, apresentamos uma análise das diferentes definições do que é um niilista apresentadas no romance de Ivan Turguêniev para, em seguida, investigar o impacto que esta publicação gerou na sociedade russa da época. A partir de todos esses subsídios históricos, a última parte do artigo apresenta uma interpretação dos dois fragmentos póstumos que dialoga diretamente com a interpretação desenvolvida por Elisabeth Kuhn, ora concordando, ora refutando certos aspectos dela. Although relatively new, such events have not passed without receiving attention from some among the foremost thinkers of our time. Given that, we intend to develop an interpretative hypothesis which, starting from the perspective opened by the reflections of Friedrich Nietzsche concerning the nihilism and the (...) great politics, seeks to understand both the violent actions which try to justify themselves from a fundamentalist world view as well as the recent political and military configuration of the U.S. liberal democracy as different forms of reaction against the deepening of the value crisis ​​through which the Western world passes. Quatro painéis de muito boa pintura, representando aspectos da vida e martírios dos Santos Mártires de Lisboa, Veríssimo, Máxima e Júlia, estão patentes no Museu Carlos Machado, em Ponta Delgada, nos Açores.Obras nunca estudadas antes de 2001, embora referenciadas documentalmente já no século XIX, permaneceram em colecções particulares até aos anos sessenta do século XX, quando foram doadas ao museu açoriano, onde se encontram em bom estado de conservação. Nunca dali saíram, a não ser um dos painéis para a XVII (...) Exposição Europeia de Arte, Cultura e Ciência (núcleo da Casa dos Bicos) e outro painel, em 1992, para uma exposição em Génova. As obras, de relativamente pequenas dimensões, são muito ricas em aspectos iconográficos e de caracterização de ambientes. Datáveis da década de 30 do século XVI, têm sido atribuídas ao pintor Garcia Fernandes e, mais recentemente, a Cristóvão de Utreque, um dos mestres que foi referenciado como eventual colaborador dos chamados Mestres de Ferreirim: Cristóvão de Figueiredo, Gregório Lopes e Garcia Fernandes.Muito interessante, no entanto, é a iconografia das paisagens urbanas de duas das pinturas, mas a vida e os martírios dos santos não acompanham o que se conhecia da literatura do tempo. Neste trabalho procuramos compreender as ideias que nortearam a ação de Frei Manuel do Cenáculo, enquanto reformador de estudos para diferentes níveis e bispo empenhado na formação do clero e dos fiéis da sua diocese. Tomamos como ponto de partida os anteriores trabalhos sobre a atuação política e pastoral de Cenáculo, para sistematizar a ação em defesa do ensino e o seu pensamento pedagógico. This article is a within- and cross-country examination of the impact of fair trade certification on consumers’ evaluations and attitudes toward ethically certified products. Across three experimental studies, the authors analyze how different levels of brand familiarity and fair trade expertise impact consumer decisions. The authors study this phenomenon across markets with different social orientation cultures to analyze potential dissimilarities in the way consumers evaluate and behave toward ethically certified products. Findings suggest that fair trade certifications enhance product valuations. However, (...) this effect is especially observed for low familiar brands, once the level of fair trade expertise increases. Findings also suggest that there are individual cultural differences with respect to social and environmental labeling expertise that may account for some of the unexplained variation in choice behaviors observed across countries. Results indicate that especially in more (mature) individualistic markets (vs. collectivistic) consumer ethical behavior seems to be greatly influenced by consumers’ perceptions about the eligibility of brands using (or not) fair trade. This effect is strengthened by the significant mediating role of consumers’ ethicality perceptions on the relationship between fair trade and the willingness to pay for brands. (shrink)

Assuming that Aristotelian ethical thought is specifically related to the problem of stability and permanency of Polis, this paper researches the relationship between the human soul and the ethical-political order. Ethical life is described as an on-going process whereby we learn how to think and desire, due to the experience of each particular situation. Ethics shows the human life as a progressive assimilation of ethical-political order in which one becomes the man one is. But, on the other hand, it also (...) shows that any order owes itself to the character of men who take part in it. Interiorising of customs – the purpose of ethical process of personal constitution – forms the man (character is built from the communitarian experience). The virtuous man’s soul is the strongest guarantee againstruination that always threatens Polis. The affirmation of a good life as a happy life in virtue – as the permanent and stable activity according to virtue – assures political order’s stability and the permanence of the Polis. This leads to a reflection about how much Politics owes Ethics: the possibility of the most esteemed idea in Aristotelian political discourse (the permanence of Polis) depends on the ethical process of human soul’s construction. The soul belongs to the order just as the order belongs to the soul. Seen as a virtue, Justice is a certain configuration of the soul (of desiring, thinking and even of feeling) of a man. The abandonment of that incarnate old conception of Justice is strictly related to the contemporary crisis of Law, whose weaknesses in legitimacy and efficacy are evident. (shrink)

Background: Frailty is a common syndrome among older adults and patients with several comorbidities. Grip strength is a representative parameter of frailty because it is a valid indicator of current and long-term physical conditions in the general population and patients with severe mental illnesses. Physical and cognitive capacities of people with SMIs are usually impaired; however, their relationship with frailty or social functioning have not been studied to date. The current study aimed to determine if GS is a valid predictor (...) of changes in cognitive performance and social functioning in patients with type-2 diabetes mellitus and SMIs. Methods: Assessments of social functioning, cognitive performance, and GS were conducted in 30 outpatients with type 2 diabetes mellitus, 35 with major depressive disorder, 42 with bipolar disorder, 30 with schizophrenia, and 28 healthy controls, twice during 1-year, follow-up period. Descriptive analyses were conducted using a one-way analysis of variance for continuous variables and the chi-squared test for categorical variables. Differences between groups for the motor, cognitive, and social variables at T1 and T2 were assessed using a one-way analysis of covariance, with sex and age as co-variates. To test the predictive capacity of GS at baseline to explain the variance in cognitive performance and social functioning at T2, a linear regression analysis was performed. Results: Predictive relationships were found among GS when implicated with clinical, cognitive, and social variables. These relationships explained changes in cognitive performance after one year of follow-up; the variability percentage was 67.7%, in patients with type-2 diabetes mellitus and 89.1% in patients with schizophrenia. Baseline GS along with other variables, also predicted changes in social functioning in major depressive disorder, bipolar disorder, and schizophrenia, with variability percentages of 67.3, 36, and 59%, respectively. Conclusion: GS combined with other variables significantly predicted changes in cognitive performance and social functioning in people with SMIs or type-2 diabetes mellitus. Interventions aimed to improve the overall physical conditions of patients who have poor GS could be a therapeutic option that confers positive effects on cognitive performance and social functioning. Emotional intelligence is a psychological skill that aids athletes in the control of emotions and optimization of sports performance. The present study investigated the psychometric properties of the Self-Report Emotional Intelligence Test in 508 Brazilian youth and adult athletes. Data analysis was conducted through Exploratory and Confirmatory Factor Analysis, Cronbach’s alpha, composite reliability and Pearson’s Correlation. EFA revealed the one-factor model with 26 items with the best adjustment. CFA confirmed the one-factor model with 26 items with best greater fit. No (...) evidence of invariance was found, suggesting that the SSEIT must be used with caution when comparing gender and age groups. The external validity was found in the correlation of EI and cognitive anxiety and self-confidence. It is concluded that the Brazilian version of SSEIT for the sports context presented acceptable psychometric properties, however, showed limitations that should be explored in the future. (shrink)

This paper addresses the question of who should be trusted as an expert and when, particularly in the context of public deliberation. Trust in experts is crucial in making decisions about public policies that involve complex information beyond the expertise of most people. However, fruitful deliberation also requires being able to resist misinformation campaigns, no matter how widespread these might be; being able, in general, to evaluate the evidence at our disposal and form our own opinions. The purpose of this (...) paper is to reflect on this apparent tension between epistemic deference and epistemic independence. The paper has two goals. First, it aims at providing a more nuanced understanding of the question of who should be trusted as an expert by examining cases in which seemingly factual claims are made in public settings by experts. Second, it emphasizes the need to pay attention to the conditions under which we actually trust each other. We suggest that fostering trust in science may be better approached by modifying the conditions under which scientific dialogue takes place, rather than trying to convince the public to trust experts, or blaming them for not doing so. In this article, we present a work developed with palliative patients with the aim of, through art, enabling them to find answers that would help them overcome situations that kept them involved in thoughts, fears, and anxiety that consumed their energy, joy, and will to live. For this purpose, we used a qualitative methodology —research-action— and the attained results revealed how arts can be useful to these patients by providing them, through the work they have developed, with an improvement in (...) self-esteem, disposition, and well-being in disease avoidance and the expression and communication of emotions. Faced with the inaction of liberal democracies to effectively tackle global warming, many climate activists engage in forms of protests that involve committing minor criminal offences. They seek to shape official decisions on climate policies by resorting to civil disobedience. Some of these activists, rather than accepting punishment, have successfully claimed to be acting in a justified manner by invoking the necessity defence. The aim of this article is to show that, within the framework of representative democracies guided by the (...) rule of law, the climate necessity defence must be rejected, since such protests do not meet the ‘non-legal alternatives’ requirement. This does not mean, however, that protesters should be punished as common offenders. Their acceptance of responsibility and political motivation should be taken into account as a mitigating factor at sentencing. (shrink)

We sometimes fail unwittingly to do things that we ought to do. And we are, from time to time, culpable for these unwitting omissions. We provide an outline of a theory of responsibility for unwitting omissions. We emphasize two distinctive ideas: (i) many unwitting omissions can be understood as failures of appropriate vigilance, and; (ii) the sort of self-control implicated in these failures of appropriate vigilance is valuable. Germany is joining a long list of European democracies that have modified or expressed a willingness to modify their citizenship laws to denationalize first and then prevent the return of or expel those citizens accused of having participated in terrorist activities abroad. The formal labelling of citizenship deprivation as an administrative measure outside the scope of criminal justice has prevented scholars of criminal law from undertaking a thorough scrutiny of its legitimacy. In this paper I seek to fill this gap. (...) Specifically, after demonstrating why deprivation of citizenship is a measure of a criminal nature, I argue against its legitimacy, either as a punishment or as a risk-based measure. Instead I propose that we should understand citizenship deprivation as a paradigmatic response from an illegitimate enemy criminal law. Notwithstanding the foregoing, I claim that states that choose to denationalize terrorists should do it within the framework of a process with the highest (criminal procedural) guarantees. (shrink)

En el antiguo comentario a la lógica aristotélica, el término griego συζυγία (syzygía) se refiere a la combinación de dos proposiciones que tienen uno o ambos términos relacionados. El término resulta ser el género desde donde se especifican las tres reglas deductivas de la lógica aristotélica: conversión (si ambos términos son comunes, pero cambian su orden), oposición (si ambos términos son comunes, pero no cambian su posición) y silogismo (si un solo término es común). Tal enseñanza no es explícita en (...) Aristóteles, pero ya es conocida por su principal comentarista Alejandro de Afrodisias junto con otros autores de su tiempo y posteriores. Este trabajo muestra que Alejandro introduce este término junto con un modelo dialéctico que identifica al silogismo con la prueba que resuelve un problema, que a su vez se define como aquello que no tiene una prueba. Este énfasis cambia la perspectiva del comentario hacia la tarea de encontrar las combinaciones de premisas que resuelven un problema. El artículo sugiere que este modelo dialéctico se deriva de la noción de combinación y proviene de autores anteriores, ya que el uso del término está atestiguado en Cicerón e incluso el propio Aristóteles lo usa en los Tópicos. El artículo sugiere la importancia de Teofrasto en el desarrollo de este término. (shrink)

Since the publication of Elga's seminal paper in 2000, the Sleeping Beauty paradox has been the source of much discussion, particularly in this journal. Over the past few decades the Everettian interpretation of quantum mechanics 1 has also been much debated. There is an interesting connection between the way these two topics raise issues about subjective probability assignments.This connection is often alluded to, but as far as we know Peter J. Lewis's ‘Quantum Sleeping Beauty’ is the first attempt to examine (...) it explicitly. Lewis claims that the two debates are not independent: to be specific, he argues that accepting the Everettian interpretation of quantum mechanics requires you to be a ‘halfer’ about Sleeping Beauty, in opposition to the more widely accepted ‘thirder’ solution.This paper will argue that Lewis is wrong. Everettians do not have to be halfers. It is perfectly cogent to be both an Everettian and a thirder. (shrink)

The aim of this work is to comment and discuss some central ideas of Tim Crane’s book The Object of Thought (2013). In particular, I pose an objection for the reductionist solution to the problem of non-existence offered by the author. Tim Crane defends that the truth of sentences that contain terms referring to non-existent objects (like 'Pegasus') can be explained by appealing to the truth of sentences about things that do exist (Pegasus’ representation in the myth). I argue that (...) this explanation does not work for sentences used in a normative or evaluative way. (shrink)

Properly speaking, the corporation, considered as an entity distinct from its members, cannot be morally responsible for wrongful corporate acts. Setting aside (in this abstract) acts brought about through negligence or omissions, we may say that moral responsibility for an act attaches to that agent (or agents) in whom the act "originates" in this sense: (1) the agent formed the (mental) intention or plan to bring about that act (possibly with the help of others) and (2) the act was intentionally (...) brought about through bodily movements over which that agent had direct control (i.e. the kind of direct mental control that I have over the body I refer to as "my" body) and through which the agent carried out his (mental) intention or plan. Corporate acts do not thus originate in some corporate entity distinct from its members because the corporation has neither a mind to form intentions nor a body it directly controls: it lacks the proper mind/body unity. Instead, corporate acts originate in individual autonomous human beings who make up the corporation and who intentionally bring about corporate acts through their own bodily movements. Such human individuals, and not "the corporation," are morally responsible for corporate acts. Moreover, to say that an entity is "morally responsible" for a wrongful act is to say that the entity is liable to blame and punishment. But it is not possible to impose blame and punishment on a corporation without inflicting it on corporate members. Thus, to say that a corporation (as an entity distinct from its members) is "morally responsible" for a wrongful corporate act is to imply that a (possibly innocent) corporate member legitimately may be punished for something for which another entity was morally responsible. This violates the moral principles that underlie blame and punishment. To hold that the corporation can be morally responsible for its acts is to adopt a dangerous organicism. (shrink)

Economics students and economists have—grosso modo—a bad societal reputation. This is, roughly speaking, the provocative result of the majority of empirical studies on economic education. On average, economists and economics students behave in a more self-interested way than others; they are more prone to deviate from the moral good; they tend to free-ride more often and invest less in public goods games; they are more corrupt and less honest in lost letterexperiments, less cooperative in solidarity games, and accept less and (...) keep more in ultimatum bargaining games. In short: they seem to behave more in accordance with the predictions of the rational or self-interest model of standard economics, the Homo oeconomicus model. What might be the reasons that the degree of anti-social and uncooperative behavior is on average significantly more pronounced among economics students compared to other student groups? Can these empirical findings be explained by the self-selection effect and/or the indoctrination effect? What are the implications of these empirical results for economic ethics and economic education? Which roles do the economics curriculum and economic textbooks play? Do they have any effect on everyday behavior? Is the way economics is taught at (business) schools, colleges and universities co-responsible for the considerable behavioral differences? And what can be done in order to reverse these trends and to foster other-regarding preferences and pro-social behavior? The paper analyzes these and other questions with the help of experimental economics, behavioral economics and neuroeconomics. It also draws on recent findings of brain physiology research in general and neuroplasticity in particular. (shrink)
